1. Introduction

These Terms and Conditions govern the provision of analytical testing services by Particle Characterisation Laboratories Pvt Ltd to clients. By engaging our services, you agree to comply with these terms.

2. Scope of Services

• Our laboratory provides analytical testing services for a wide range of materials, including but not limited to pharmaceuticals, chemicals, food products, and industrial materials.
• The testing services are conducted using standard operating procedures and in compliance with industry regulations.
• Test results are provided solely for informational purposes and should not be considered as a substitute for regulatory approvals or certifications unless explicitly stated.

3. Customer Responsibilities

• You are responsible for providing complete and accurate information regarding the samples, including composition, safety hazards, and handling instructions in the sample analysis request form.
• Any specific testing requirements must be communicated clearly at the time of placing the order.
• The laboratory reserves the right to refuse or discontinue testing if the provided information is incomplete, misleading, or if the sample poses a safety risk.

4. Sample Handling and Storage

• All received samples are assigned a unique identification number for tracking purposes.
• Proper care is taken to ensure the integrity of the sample during testing. However, the laboratory is not responsible for degradation due to the nature of the material.
• Samples will be retained for a specific period after analysis, as per our internal policies, unless otherwise agreed upon. After this period, they will be safely disposed of following regulatory guidelines.

5. Turnaround Time

• Estimated turnaround times for analysis are provided at the time of order confirmation. These timelines are subject to change based on workload, technical difficulties, or unforeseen circumstances.
• Any delays beyond the agreed timeline will be communicated to you promptly.

6. Confidentiality and Data Protection

• All client information, including test results, will be kept strictly confidential and will not be shared with third parties without written consent, except where required by law.
• We implement robust security measures to protect customer data from unauthorized access.

7. Liability and Limitations

• While we strive for accuracy, the laboratory cannot guarantee that test results will be free from errors. Results are provided based on the best available scientific methods.
• Our liability is strictly limited to the cost of the service provided. We are not responsible for any consequential losses incurred by the client due to reliance on test results.

8. Payment Terms

• All payments must be made as per the agreed terms mentioned in the quotation or invoice.
• Late payments may incur interest charges and could result in a suspension of services.

9. Force Majeure

• The laboratory shall not be held liable for delays or failure in service delivery due to circumstances beyond its control, such as natural disasters, technical failures, or regulatory changes.

10. Amendments to Terms

• We reserve the right to amend these terms at any time. Updates will be communicated to clients as necessary.

Shipping Policy

1. Sample Submission

• Clients are responsible for properly packaging and labeling samples before shipping to ensure their integrity during transit.
• Any special handling or storage requirements must be clearly mentioned at the time of dispatch.
• The laboratory does not accept responsibility for delays, damages, or loss of samples during transit.

2. Sample Receipt and Acknowledgment

• Upon receiving the sample, we will verify its condition and send an acknowledgment.
• If any sample is found to be damaged or unsuitable for testing, the client will be informed immediately.

3. Report Delivery

• Test reports are typically shared electronically via email or an online portal.
• If a hard copy is required, it will be sent via courier, and additional charges may apply.
• If a hard copy is required (domestic or overseas), we will specify the estimated delivery timeline (typically the timeframe will be approximately 2 - 3 weeks after invoicing).
  

4. Shipping Charges

• Clients are responsible for all shipping costs associated with sending samples unless otherwise agreed upon in writing.
  

Cancellation and Refund Policy

1. Order Cancellation

• Cancellation requests must be submitted in writing within 24 hours of placing the order.
• If the testing process has already begun, cancellations will not be accepted.

2. Refund Policy

• Refunds are only applicable in cases where the laboratory is unable to conduct the requested test due to internal constraints.
• If testing is completed, no refunds will be issued.

3. Re-Testing Policy

• If an error is identified in the test results due to a laboratory mistake, a re-test will be conducted at no additional cost.
• If a re-test is requested by the client without any technical justification, additional charges may apply.

4. Dispute Resolution

• Any disputes related to testing, payments, or service quality will be reviewed internally.
• Clients will be notified of the resolution within a reasonable timeframe.

5.  Refund Timeframe

• A refund will be processed within 15 days, but only in cases where an advance payment was made and the analysis was not performed, as per the mutual agreement between PCL and the customer.
  

Privacy Policy

1. Collection of Information

We collect personal and business information, including but not limited to:

• Name, contact details, and company information
• Billing and payment information
• Sample details and test requirements

2. Use of Information

The information collected is used to:

• Process and fulfill orders
• Communicate test results and updates
• Improve our services

3. Protection of Data

• We take necessary measures to safeguard personal and confidential data from unauthorized access.
• Only authorized personnel have access to sensitive information.

4. Sharing of Information

• We do not sell or share customer data with third parties unless required by law or with explicit consent.

5. Retention and Deletion

• Customer data is retained as per regulatory requirements and is securely deleted once it is no longer required.
